Welcome to the Holiday Rocks. These terms and conditions govern participation in the auction. By participating, you agree to be bound by these terms.
2. Eligibility
• Participants must be at least 18 years old.
• By registering, you confirm that the information provided is accurate and complete.
3. Registration
• Bidders must register prior to the auction including final form of electronic payment
• The auction organizers reserve the right to refuse or revoke registration at their discretion.
4. Auction Items
• All items are donated and sold “as-is.”
• No guarantees or warranties are provided regarding the quality, value, or functionality of auction items.
• Descriptions of items are provided in good faith but may contain inaccuracies.
5. Bidding
• All bids are binding. By placing a bid, the bidder agrees to purchase the item if their bid is the highest at the close of bidding.
• Bids must be placed in increments determined on the site
6. Payment
• Successful bidders must pay for items in full at the end of the event.
• Accepted payment methods are listed on the website
7. Item Collection
• Items must be collected on the day of the auction at the Kessler Theater
• Proof of payment is required for collection
• If an item is not picked up at time of the auction handling or shipping may be charged
8. Liability
• The organizers are not responsible for any damages, defects, or issues with the auction items after the sale.
• The organizers are not liable for any losses or damages incurred by participants during the auction.
9. Refunds and Cancellations
• All sales are final. No refunds, returns, or exchanges will be permitted.
• The organizers reserve the right to cancel or modify the auction at any time.
10. Use of Proceeds
• Proceeds from the auction will benefit Music Meets Medicine. A breakdown of fund allocation is available upon request.
11. Privacy
• Personal information collected during registration will be used solely for the purposes of the auction and will not be shared with third parties.
12. Changes to Terms
• The organizers reserve the right to amend these terms at any time. Updated terms will be made available prior to the auction.
13. Governing Law
• These terms are governed by the laws of Texas. Any disputes arising from the auction shall be resolved under these laws.
